“SA’s labour laws are inflexible and hinder investment: myth or reality?


South Africa's labour laws are often accused of being inflexible and a key factor limiting econmic growth. This generalisation is open to challenge: while there are areas requiring reform, the law by and large strikes a balance between the interests of capital and labour, seeks to limit potential for abuse and is no more restrictive than many other pieces of protectionist legislation. Often times the inflexibility employers experience result from self-imposed policies, procedures and contractual arrangements as well as poor internal advice.

SPEAKER
Barney Jordaan holds a doctorate in law from Stellenbosch University and was admitted as an attorney of the Supreme Court of South Africa in 1982. He was professor of law at Stellenbosch University until 1997, when entered full-time practice as a specialist in the areas of employment law and labour relations, but later also in the areas of negotiation, mediation and conflict management.
He is currently professor extraordinaire at the Graduate School of Business of Stellenbosch University (USB) where he teaches on the MBA and executive education programmes. He is also visiting lecturer at the Graduate School of Business of UCT and at Vlerick Leuven Gent Management School in Belgium.
At the USB he heads up the USB’s Africa Centre for Dispute Settlement (www.usb.ac.za/disputesettlement). The Centre is an African hub for academic research, development and teaching of dispute settlement theory and practice. Amongst others, it offers the only Postgraduate Diploma in Dispute Settlement in South Africa. 
Apart from his academic involvement, Barney is a director and co-founder of Maserumule Consulting, a leading firm of employment relations, employment law and organisational growth specialists, with offices in Cape Town and Johannesburg.
He is a senior arbitrator and mediator having been involved in ADR since 1987. He is certified by the International Mediation Institute in the Hague, and chairs the International Bar Association’s mediation across border sub-committee. In May 2011 he was appointed as external short-time consultant to the World Group’s Office of Mediation Services. He is listed in the 2011 Who’s Who Legal (Commercial Mediators) of the International Bar Association, one of three in the RSA. During 1996-1999 he was part-time senior commissioner at the CCMA and part of the training panel for the first intake of commissioners. He appears regularly on regional and national radio and has published widely and is the author and co-author of a number of leading academic and popular works.
